Six appeal PVO Bill Parliamentary public hearings to Con-court

0

By Beverly Bizeki

Six civil society leaders from across the country have written to the Constitutional Court to order the Parliament of Zimbabwe to reconvene Private Voluntary Organisations (PVO) Amendment Bill hearings in four provinces arguing that the public hearings in these provinces failed to meet constitutional obligations.
The draft order in the court application has since been received by the court, with parliament expected to respond within 21 days according to the dictates of the constitution.
The six applicants are Farai Maguwu, Jonah Wakurawarerwa, Donald Chitanha, Passionate Fuza, Ephraim Mthombeni and Brisky Fanuel Ncube with the only respondent being the Parliament of Zimbabwe.
In the founding affidavit, the first applicant Farai Maguwu, argues that the hearings were not done procedurally as some participants were jeered at when they gave their views on the bill while the time that was provided for the meeting was not enough to have the whole province participate.
“(Then) the chance to speak was given to one lady, Passionate Fuza, the second applicant herein, she spoke against the bill and the crowd started jeering. Although the committee members tried to bring the house to order they were not successful. The room became chaotic to the extent that we could not hear each other.
“The group that was jeering and singing, disrupting the proceedings is the one that supported and cheered when its members spoke in favor of the bill.
“I further aver that the venue itself was too small to accommodate a sizeable and reasonable amount of people who could speak for and against the bill. Section 141 of the constitution provides that the respondent must facilitate public involvement in its legislative processes as well as ensuring that interested parties are consulted about bills being considered by it. This was not done. Interested parties like Non-Governmental Organizations (NGOs) were not consulted.
“To convene a public meeting for the whole of Harare Province at one venue for the just two hours from 1400hrs – 1600hrs was not adequate to meet the constitutional threshold,” reads the appeal.
Another applicant, Jonah Wakurawarerwa who attended the hearing in Masvingo said they were disturbed by violence and the participants could not give their contributions on the hearing.
“Despite arriving at the venue a few minutes after 1200hours, the theatre was already full hence I had to stand by the entrance at the theatre. I personally requested the Chairman, Mr Mavhenyengwa to have the hearing moved to a different venue which could accommodate more people. I was accused of disrespecting the chairman by some Zanu PF members. This resulted in violence from Zanu PF members who started to shout and assault people.
“When the hearing started, the chairman had highlighted that he would take contributions from representatives of organisations first before moving on to entertain other members of the public. The violence however began before members had been given an opportunity to make their contributions because the meeting ended abruptly as a result of violence,” reads part of the appeal.
For Chinhoyi, the fifth applicant, Donald Chitanha said the hearing became politicized.
“I noticed that quite a large number of Zanu PF MPs and Senators were in attendance. Some Zanu PF members who were in party regalia were making political slogans before making their contributions spoke in support of the bill.
“When I was given the opportunity to make my contributions I spoke about how the bill would negatively impact NGOs and the work they are doing in our society. I was directed to retract my statements by some Zanu PF members and MPS who accused me of being anti-government. They further threatened me and said I would face consequences for my statements. Further to the threats I was surrounded by a group of Zanu PF members that threatened to beat me. I could not finish my contribution as a result of the threats and mob that was advancing towards me,” reads another part of the application.
The application also details how in Gweru only eight people made contributions in the meeting before the meeting was disrupted.
In the PVO Bill Amendment, government is advocating for a streamlined registration process to prevent fraud as they have been claiming that charity organizations were registering as trusts.

GBV One-Stop-Centre for Masvingo

By Rangarirai Shanyurai

Ministry of Women Affairs, Community, Small and Medium Enterprises Development has established a One-Stop-Centre for Gender Based Violence (GBV) for survivors in Masvingo at Chesvingo Safe Market recently commissioned in Mucheke.
Chesvingo Safe Market, which was established by government with support from African Development Bank (AfDB) and Masvingo City Council was officially commissioned by the Minister of Women Affairs Senator Monica Mutsvangwa.
The safe market which is set to benefit at least 80 women and youths involves a pre-school as well as a One Stop Centre for victims of GBV.
It will also partner with Victim Friendly Unit, Zimbabwe Women Lawyers Association (ZWLA) and Musasa Project to empower survivors of GBV also offering counselling services before an issue is directed to ZWLA.
Speaking at the commissioning, Mutsvangwa said the safe market was an example of how government and its stakeholders can support women-owned businesses by ensuring that they are operating in safe workspaces, free of GBV.
“The Safe Market will prioritize the provision of a safe workspace for women and youth entrepreneurs, education for children and services to survivors of GBV. This is in line with Vision 2030 which aims at achieving an upper middle-income society.
“By providing a dedicated workspace like this safe market for women, the ministry is empowering them to contribute to economic growth. We still have more women who need decent workspaces and let’s continue to collaborate and provide such spaces for them,” said Mutsvangwa.
Masvingo Minister of State Provincial Affairs and Devolution, Ezra Chadzamira encouraged women entrepreneurs to utilise the opportunities presented by the facility in growing their businesses.
“I encourage all small business owners, especially our women entrepreneurs, to take advantage of the opportunities it presents. Utilize the market, the pre-school, the One-Stop Centre, and the other essential services to grow your businesses, thriving in a safe and supportive environment,” said Chadzamira.
Beneficiaries welcomed the project saying it enabled them to get a safe space for working as well as making services for GBV survivors accessible.
“We are very excited today as women, that the government and its partners have remembered us with this facility as women and youths such that we have a safe space for work where we can sell our products. Most women are victims of sexual and gender-based violence, so this institution provides safe shelter and counselling making the services accessible to women in the residential areas. As you can see this market is responsive,” said one of the beneficiaries.
Another woman at the event said she was grateful for the facility which enabled them to work with their children close by at the preschool.
“As women, we feel safe that we will be able to work while our children are learning at this pre-school. Again pertaining to GBV we now have One Stop Centre of victims or survivors that is Victim Friendly Unit (VFU),” she said.

Masvingo artist to raise awareness on GBV against men, boys

By Decide Nhendo

Victims of gender-based violence (GBV) are commonly women and girls, but it is undeniable that men and boys are also targeted. It is thus a travesty that males who experience GBV receive less attention than females and that such cases remain hidden.
Masvingo-based musician Kennedy Ganda is setting his sights on these less addressed GBV issues targeted at man, saying he is determined to reach greater heights as he works to popularize his work across the country.
Ganda who is known in music circles by the name KennyGizzy99 said financial constraints are a major setback to his desire to communicate societal ills, but he vowed to keep on pushing his agenda.
“I am working tirelessly as an artist to address GBV against men and boys and my next project a song titled ‘Haruna’ is a song that looks into men and boys that are being abused by women. When these issues are raised, authorities only prioritize women and girls alienating men, so I am trying to stand for them and make their voice be realized in societies as they can also be victims of GBV.
“My main calamity as for now is lack of funding because in all seven songs I have released only one song ‘Mwana uye’ has visuals, of which visuals are an excellent way to lure fans to listen to an artist’s message,” said Ganda.
Ganda who said he is an Afro-pop, contemporary and Afro-Jazz musician started in 2021 after he broke his leg while playing soccer, with his debut song and video ‘Mwana uye’ earning him best upcoming artist in the same year in a local competition.
After his first single he went on year to release an extended play (EP) with 3 songs; ‘Lydia’, ‘Kidznet’ and ‘Cheu Cheu’ a gospel song that he said was received well by the audience, but did not meet his expectations since it did not have visuals.
He ceased composing new songs to have enough time to push his released songs and in late 2022 he released his second EP which had two tracks ‘Hombarume’ which he said was mainly a cultural song, and ‘Chibhareta’ which he said celebrated women.
Ganda said he has been going for auditions in Masvingo and cities like Harare where he emerged one of the best performers in some cases, but his displays were in vain since sometimes he was duped by event organizers, which shows a great setback to the growth of music industry.
“I have been doing auditions locally here in Masvingo and big cities like Harare, and sometimes I could outperform my other counterparts but in most cases I could not receive the promised prizes or I could receive the prizes reduced which shows that most promoters do not value upcoming talent, ” said Ganda.
He appealed to Masvingo community as well as other well-wishers who wish to assist him saying that he was ready to use his talent for the better. He said he aims to do tours in schools, and other public places raising awareness about challenges that are affecting communities like drug abuse and early child marriages.
“I ask those who are willing and capable to assist me on my endeavor because I am sure if I get the equipment and money to create visuals and do what other modern artists are doing nothing can stop me from to reach higher heights,” he said.
Ganda also said he is working with producer Wellington Mapanzure also known as Savil Music who hails from Mucheke B and he said they were working on other songs that are yet to be released.
“I am working with Savil Music from Mucheke, and as it stands everything is flowing smoothly, we have a number of songs which we are working on, and I am sure music lovers are going to enjoy the new songs when they are released,” he said.
Those who want to listen to his music can follow him on Facebook on Jindaguru Rekumakumucha, YouTube channel KennyGizzy99 aka Jindaguru, Instagram on jindagururekumakucha and Jindaguru Rekumakumucha on Spotify.

Mwenezi teacher takes rural athletics to next level

By Decide Nhendo

A Mwenezi teacher from Neshuro High School has taken athletics to another level after he started training learners to compete in professional open athletics.
Stephen Mpofu, who is a holder of Level 2 medium and long-distance coaching said many people were undermining the potential of athletics to make a decent living for an individual, so he decided to go above and beyond the normal standards despite financial constraints.
“I realized that the learners I have been working with during school competitions had great potential to improve, so I took this opportunity to nurture them to raise their standards so that they can participate in professional athletics.
“So from the previous year to date the learners have been competing in some open athletics competitions where they have proved to be fit, scooping top elite prizes, despite lack of resources,” said Mpofu.
Mpofu said with the help of other local well-wishers he provided for the learners to compete in various open professional competitions where the learners proved to be competent.
“When we go for competitions sometimes I stay with the learners at my home while preparing to go for competitions.
“It is difficult because sometimes I fork out money from my pockets to provide food and other athletic stuff to the kids, but help from other few well-wishers lessen the burden,” said Mpofu.
Mpofu who said his dream is to register a medium and long distance club with more athletes is currently training his local learners who are willing to improve their skills.
He said the learners had a lot of competitions they were eligible to participate in, but lack of money restrained them from partaking in these races.
“My dream is to have a medium and long-distance club so that I can nurture talents from remote areas because there are a lot of learners there who can be great athletes if they take their time to practice.
“The learners I am training were eligible to participate in many competitions which take place nearly every week, but because of lack of funding, they are not competing,” he added.
One of his athletes Simbarashe Muteuro came first when he participated in five kilometers Madzingo Memorial Half Marathon race in Gutu on December 9 last year where he walked away with a US$ 70 prize money.
Muteuro also came second at the Musabvunda half marathon in Harare on December 16 last year.
Another athlete, Rutendo Moyo came second at Beitbridge Mayor’s half marathon on June 22 2024.
Mpofu said the learners were going to participate at the Zimbabwe School of Mines (ZSM) marathon on July 27, and also at the Zimbabwe Prisons and Correctional Services (ZPCS) Commissioner General’s Goodwill Trust Fund Half Marathon to take place on August 24. He appealed to the public calling for those capable to come and assist the learners so they can be able to take part in the coming competitions.
Mpofu urged parents to support their children in athletics since some of them scooped money prizes which they used to do starter-up businesses to raise money for athletics necessities.
“I call for all parents to support their children who are into athletics because when they scoop prizes it is for their advantage.
“When learners won prizes in previous competitions they started small businesses, with some of the money being used for other sporting necessities including other needs at their homes, ” said Mpofu.

Former Mwenezi CCC organizer jailed 36 months

By Cephas Shava

Mwenezi – Former Mwenezi district organizer of the Citizens Coalition for Change (CCC) then led by Nelson Chamisa, Tineyi Mapepa who has been facing charges of inciting violence was on Tuesday, July 16 sentenced to 36 months behind bars by Mwenezi Magistrate Conceptor Ngwerume after a full trial.
Mapepa (46) of village 4 Muzhanjire Ranch in Mwenezi District was being charged with incitement as defined in Section 187(1) of the Criminal Law Codification and Reform Act Chapter 9:23.
He was being represented by Noble Chinhanu of the Jiti Law Chambers and had pleaded not guilty to the charges but was, however, found guilty after a full trial.
Ngwerume sentenced Mapepa to 36 months behind bars of which 16 months were conditionally suspended and he will serve an effective 20 months in prison.
It was the state’s case as presented by Prosecutor Leyton Katsidzira that on July 23, 2023 while at Rutenga Business Centre in Mwenezi at around 1415hours Mapepa convened a meeting on behalf of the CCC party at the business center. The meeting was sanctioned by the police to start at 1400hrs and to end at 1600hrs.
The State argued that since Mapepa was one of the CCC leaders, at 1600 hrs he was asked by police officers to disperse the crowd but the accused reportedly refused as he allegedly started to tell people not to disperse and the crowd heeded up until 1700 hrs when a convoy of then party leader Chamisa arrived at Rutenga Growth Point.
The State further argued that police officers approached Mapepa and his crowd to try and disperse them but he and other members pelted them with stones, threatening to assault them. The officers later on managed to disperse the crowd.
Mapepa was then subpoenaed by police to attend court months after the incident, subsequently leading to his arrest, trial, and conviction for incitement.

Zanu PF threatened by opposition activities in its strongholds

By Brighton Chiseva

MASVINGO – After failing to fulfill most of its campaign promises, Zanu PF is worried by developmental activities being done by members of the opposition in the ruling party’s strongholds.
This was revealed by the party’s National Political Commissar Munyaradzi Machacha who said the party had noted a heightened number of activities by the opposition mainly the Citizens Coalition for Change (CCC) warning MPs to be alert lest they will lose in 2028.
“The party relies on you so that the party’s visibility in the constituencies remain high but some of you are now absentee MPs in your constituencies. Some of you could be on genuine assignments for parliament but remember our enemy is taking advantage of your absence.
“We are seeing heightening activity of the opposition especially CCC in our strongholds. They are organizing themselves doing meetings at their households. Some are organizing sporting tournaments while others are giving out mealie meal since there is drought. After winning, our MPs went to Harare and did not come back like they have gone to South Africa,” said Machacha.
Former Zanu PF stalwart Dzikamai Mavhaire’s son Moses Mavhaire who was representing the Nelson Chamisa-led CCC in Masvingo Central is one opposition member who has been organizing sport tournaments and donating food among other aid in the community.
Machacha said MPs should be visible to the electorate even if they do not have money to give them saying they needed to show love to their electorate if they are to make it in the next election.
“So MPs, we urge you to go back to the people even if you do not have money. It’s good to just pass through communities greeting people. It doesn’t mean that you have to go there when you have something to give them. They need love and advice, they have to come to you asking for advice and you refer them to responsible authorities. That is what they want, you are facilitating development that way,” said Machacha.
He said being absent would lead to the sitting MPs losing during primaries and that would mean that the party would have new faces in parliament every election which was costly for the party and government itself.
“We are having a challenge where we have new faces every time. The new MPs are elected, by the time they learn about their responsibilities and also deliver in their constituencies, the five year term would have lapsed and a new team gets in again. How will we return the experience and institutional memory every five years? The contacts you would have made will be lost and that is a disaster for Zanu PF. You have to be loved by the electorate because we need MPs who do at least 2 terms and that strengthens the party,” said Machacha.
Machacha said Zanu PF relied on Masvingo and had potential because of numbers and also had agricultural potential that if fully utilized it could feed the whole country and the rest of the southern region.
“No one can doubt that you want your President. You were blessed with Apostolic and Zion churches that promote child bearing so you have the numbers. However, in 2023 your votes decreased from 318964 in 2018 to 307383. However, even Chamisa’s fell from 171 438 in 2018 to 167814 in 2023 which shows there was a general apathy. However, we want to agree here that this will not happen again in Masvingo,” he said.
Machacha was responding to concerns that had been raised by the Provincial Chairperson Robson Mavhenyengwa who had said MPs were not supporting the party’s restructuring exercise and that was delaying progress.
Mavhenyengwa also asked for an extension of the timeframe to finish off the restructuring exercise.
He said they were facing challenges in areas where there were independent candidates saying people did not understand that standing as independent mean automatic expulsion and that was affecting the cell registration exercise.
“We have challenges in areas where there were independent candidates, Gutu East and Mwenezi West. There are some people who are failing to understand that an independent candidate expelled self by standing as such. There are also some of us who do not want to accept those who were following an independent candidate when they want to return,” said Mavhenyengwa
Mavhenyengwa also complained that they had fuel as well as transport challenges and said some MPs were forgetting that they came from the party.
“We have some MPs who are not helping, even when cell verification is done in their constituencies, they do not go there and do not even know the number of cells in their constituencies. They forget they come from the party. I got some names of those not taking part from the DCC chairpersons and we are going to call them and remind them that the positions they have belong to the party,” said Mavhenyengwa.

New Zanu PF PC Machacha in dilemma

… as Masvingo pushes for Mnangagwa third term

By Brighton Chiseva

MASVINGO – The Zanu PF National Political Commissar Munyaradzi Machacha said Masvingo has put him in a tight spot after calls for the extension of Mnangagwa’s rule with another term.
Machacha was responding to calls made by speakers at a Zanu PF Provincial Inter-District meeting held at Masvingo Poly last Saturday where he said Masvingo had given him a huge task since Mnangagwa recently promised to retire in 2028.
“Everything starts in Masvingo. You once sang a song ‘Kumagumo kune nyaya’ and we saw it happening. Now the President spoke in Mutare and said when his two terms lapse he wants to go and rest. He said he would leave someone to finish his vision. Zvino Masvingo yati kwete, ngavarambe vachingotonga. Zvino ndondoti chii kuna President. Ndonoti President Masvingo yati ngavarambe vachingotonga. Ivo vachiti ndoda kumbozorora? Varume muri kundipa mutoro unorema. Zvisinei mutoro wacho ndichatakura. (Now Masvingo is saying no, he should continue ruling. So what am I going to tell him? Should I tell him that Masvingo is saying you should continue? You are giving me a burden, however, I will carry it),” said Machacha amid ululations and shouts.
The crowd shouted that Mnangagwa did not vote himself to be President but it was them who voted for him, so he should listen if they call for another term.
Provincial Chairperson Robson Mavhenyengwa told Machacha that Masvingo was united and whatever they declared would pass.
“Let me assure you sir that Masvingo is united. Everyone supports Zanu PF and President Mnangagwa. No one does anything without the other and if you want anything to do with Zanu PF come to Masvingo. If we say President Mnangagwa will still be there that means it’s a collective voice,” said Mavhenyengwa.
Other top leadership members who were present at the meeting included Minister of State for Provincial Affairs and Devolution Ezra Chadzamira, Minister of State in the President’s Office Lovemore Matuke and Zanu PF Secretary for Mines and Mining Development Paul Mangwana.
They all chanted the slogan ‘2030 VaMnangagwa vanenge vachipo’ although the president recently announced that he was going to step down at the end of his second term.
Everyone who spoke at the meeting did the same slogan except for Machacha, and every song that was sung there was an endorsement of Mnangagwa’s third term.
Earlier, soon after Mnangagwa announced that he was going to leave office in 2030, Mavhenyengwa told TellZim News that Masvingo was going to decide its position regarding the third term issue at the inter-district meeting.
Commenting on the issue, MDC party leader Douglas Mwonzora, who was co-chairperson of the 2013 constitutional-making board said there was no way Mnangagwa could secure a third term unless he had torn the constitution since it was designed in a way that any change to the term limit cannot benefit the incumbent.
“There is no way Mnangagwa can get a third term unless they tear the constitution. When we designed the constitution we took cognizance of issues like these and we made sure that no sitting President can benefit from any change of the constitution with regards to term limits,” said Mwonzora.
Another constitutional law expert Professor Lovemore Madhuku said it was not feasible to have the constitution changed for the President saying it was unconstitutional and already too late.
“That is irrelevant; the constitution cannot be changed now. Whether the President wants to or not, he has to step down. The announcement of his retirement is not a voluntary act but a constitutional dictate.
“The people who are pushing for his third term assume they have the power to change the constitution but it is too late for that now,” said Prof Madhuku.

Masvingo old dumpsite gives EMA headache

By Tatiana Mhararira

Masvingo City Council’s old dumpsite in Runyararo West has been said to be causing headaches for Environmental Management Agency (EMA) in Masvingo Province with the agency receiving complaints from residents over pollution coming from the site.
Addressing journalists at a media workshop hosted by EMA at Urban Lifestyles Hotel, Masvingo Provincial Manager, Milton Muusha said poor waste management at the old dumpsite was becoming a cause for concern in Victoria Ranch and Runyararo West.
“Masvingo City’s old dumpsite is giving us some headaches. We have sleepless nights receiving calls every day from residents who would be complaining of pollution at the dumpsite,” Muusha said.
Muusha said it was relieving that the local authority was working on another sanitary landfill that could start operating soon putting an end to continuous pollution in areas around the old dumpsite.
“It is relieving though that the local authority is working on another sanitary landfill that could start operating soon and putting an end to continuous pollution in areas around the old dumpsite,” said Muusha.
He added that poor waste management can be attributed to the growth of settlement at Victoria Ranch and local authorities have failed in the collection and safe disposal of waste.
“Poor waste management has risen due to growth of settlement at Victoria Ranch. There is limited capacity by local authorities for collection and safe disposal of waste,” said Muusha.
Muusha also said water pollution is one of the environmental problems giving the agency headaches.
“Water pollution is caused by poor management of industrial waste and effluent water. Industries dispose industrial waste and hazardous chemicals into Mucheke River and other surrounding water sources,” he added.
Muusha stated that water pollution has led to high water treatment costs.
“Due to water pollution of hazardous chemicals that has led to high water treatment costs with chemicals such as aluminum, HTH chlorine, carbon and others are very expensive to purchase,” said Muusha.
There has been ongoing conflict between residents in the western suburbs of Masvingo city with Masvingo City Council over the Victoria Ranch dumpsite, with smoke and flies coming from the dumpsite threatening the health of many residents there.
