Sex with minor: boy saved from jail

CHIVHU – Age rescued a 16-year-old Buhera boy from going to jail when he was found guilty of repeatedly raping his 14-year-old niece and impregnating her.
Chivhu Magistrate, Fadzai Mutombeni sentenced the boy to two years behind bar but suspended the term on condition that the juvenile does not commit a similar offence over a period of five years.
It was the State’s case that in April 2016 around 20:00 hrs, the boy, who is uncle to the girl, visited the girl at her place where she stays with her grandparents.
Later that evening, the grandparents retired to bed leaving the girl and the boy in the kitchen hut where the girl slept.
She then spread her blankets and asked the boy to leave so that she could sleep but the boy remained seated and later on approached her bedding and raped her.
The girl tried to scream but the boy told her to keep quite saying if her grandfather finds out, both of them would be beaten nonetheless.
The two had unprotected sex several more times that month without the complainant’s consent but the matter came to light on the July 29, 2016 after the complainant was taken to Mushipe Clinic after she had developed signs of pregnancy.
The juvenile later on disclosed the culprit and the matter was reported to Dorowa Police Station leading to the arrest of the boy.
