Mother, son charged for juvenile rape

CHIREDZI – Tracy Kusakaniko (58) of village 4 Melrose, Manjirenji in Chiredzi locked doors while her son, Erison Zimhondi (29) allegedly detained and raped a 13-year-old juvenile after she had been sent to their homestead to ask for some salt.
The duo are being charged with rape as defined in the section 65 of the Criminal Law Codification and Reform Act chapter 09:23.
Chiredzi Resident Magistrate Constance Mutandwa heard that sometimes in April this year at Zimhondi homestead village 4 Melrose in Manjirenji, Kusakaniko connived with her son and locked in the complainant to be abused.
She then left her son and the complainant locked in the room before the accused undressed and ordered the complainant to undress herself but she refused. He then forcefully removed her clothes and had sexual intercourse with her.
A while later, he laid the complainant on her back and had sexual intercourse with her again without her consent.
The following morning the complainant went out of the room when Kasikaniko opened the door and went on to tell her sister what had happened leading to the arrest of the suspects.
On his initial appearance, Erison, who is being represented by Charles Vhudzi of Zimbodza and Associates, was released from custody because he was over detained by the police.
Kasikaniko was kept in custody and they will appear in court next week for continuation of trial.
