No one is above the law- Mahofa

The Masvingo Minister of State for Provincial Affairs Shuvai Mahofa has told the crowd which attended the Judicial Service Commission (JSC) open day held in Masvingo today (Saturday) that no one is above the law and every person has the right to seek legal aid whenever they feel threatened.
Speaking at the event as the guest of honour, Mahofa said that there are a lot of people especially women who are scared of approaching the courts whenever they are offended.
“I want to thank Chief Justice Godfrey Chidyausiku and the Judicial Service Commission for bringing this event to Masvingo so that the people can know what happens in their courts.
“A lot of people are scared of the courts and think that whenever they are called to appear before the courts they will be going to jail, no, I want you to take advantage of this event and talk to the judiciary people in the country and get legal aid,” said Mahofa.
“I want to make it clear that the law in this country applies to everyone and no one is above the law. Ministers or even the judges themselves can be arrested and imprisoned,” added Mahofa.
Mahofa went on to say that women have to take advantage of the presence of courts and lawyers to ask on how maintenance cases are applied for so as not to be victimized in the future.
“Women you have to get advice from the legal experts present here today pertaining how maintenance cases are handled. You have to know how to report cases especially domestic violence when they occur to you.
“Every person has the right to get protection. Even from abusive boyfriends. If you report any abuses the perpetrators will be arrested,” reiterated Mahofa.

However, just yesterday, a woman who identified herself as Ropafadzo told VP  Mnangagwa that she had a child with a powerful politician, whose name was not mentioned, and is not able to file for maintenance since no judge or police wants to be involved in the case for fear of victimisation.
The woman said that the baby’s father does not want to be involved in the case because that would put his name in disrepute and ruin his political career. She said that the politician’s relatives have taken the 2year old baby from her and have stopped her from seeing her baby.
“Honerable VP, I had a child with one of your powerful politicians seated with you there…I do not know if my child is still alive because he was taken from me by his relatives. No police officer or judge wants to handle my case… I will not find peace until i know the welfare of my child,” pleaded the lady.
But Mnangagwa replied, “Of all the politicians here present and others out there, no one is above the law. When they commit an offense they pay for it and you should report your case to the police once again so that you can be helped. The courts will decide what is good for the baby,”.

Chiefs cannot be neutral: Mnangagwa

Vice President Emmerson Mnangagwa, who is also the Minister of Justice, Legal and Parliamentary Affairs has rubbished the neutrality of traditional leaders as enshrined in the constitution saying the clause only passed for the sake of progress.
Chapter 5 of the constitution recognizes the judicial powers of traditional chiefs but also states that those powers must be exercised impartially.
Section 280 (2) partly reads: “Traditional leaders must not- … (b) act in any partisan manner (c) further the interests of any political party or cause…”
Speaking at a judicial open day event in Masvingo, Mnangagwa, however stated that the neutrality of chiefs is practically impossible since their participation is crucial in ZANU PF’s political strategies.

The constitution making exercise was often marred by several disagreements that at some stages threatened to stall the process.

Mnangagwa further said chiefs were instrumental in the identification and mobilization of the ruling party’s support base to ensure victory at elections as was the case in the recent parliamentary by-elections.
“In Tsholotsho, we delivered our message through the chiefs; neNdebele yatatisingagoni yakabuda tichivaudza kuti vhoterai mwana wenyu. Vanhu vakasara vakatovhota saizvozvo isu tadzokera zvedu kuHarare (We had to plead with the chiefs in the little Ndebele that we knew to tell their subjects to vote for our candidate. The people ultimately did that but we had already gone back to Harare),” said Mnangagwa.
The Tsholotsho by-election was won by Professor Jonathan Moyo after a grand campaign programme that included an array of traditional chiefs from the area.
ZANU PF has often denied opposition claims that chiefs are being used to further partisan political interests.
The event was attended by a host of traditional leaders including Council of Chiefs President; Fortune Charumbira, Chief Serima of Gutu and Chief Nyakunhuwa of Zaka.politics

New constitution is Zanu PF victory: Mnangagwa

Vice – President, Emerson Mnangagwa today told a gathering in Masvingo that the new constitution is ZANU PF driven, as people who voted the referendum are the same who voted for in the 2013 harmonized elections which gave power to the revolutionary party.
Speaking at an event organized by the Ministry of Legal and Parliamentary Affairs aimed at allowing the minister to unpack the provisions of the new constitution, Mnangagwa told hundreds of people at Masvingo Polytechnic that  ZANU PF supporters who helped the party to win elections were the same who voted for a “yes” to the referendum.
 “The nation is ruled by many who consist of the ruling government, not forgetting the majority who put the government to power through the ballot, “said Mnangagwa..
Mnangagwa further likened ZANU PF influence to that of the biblical era where Solomon was instructed to take charge of Israel’s twelve tribes in providing and submitting to God’s law.

“This is not unique to modern day or ZANU PF alone where the ruling elite has influence to the rule of law as it can be traced back to biblical times where Solomon was instructed to lead many, that is the twelve tribes of Judah under God’s commandment with ultimate influence of enacting the law,” said Mnangagwa.
Meanwhile, Permanent Secretary in The Ministry of Legal and Parliamentary Affairs, Virginia Mabhiza highlighted that the Ministry has since printed more than 500 000 copies of the Zimbabwean constitution in English, 350 000 in other languages and 4 000 in braille for the benefit of the visually impaired.
She further said that as government they are trying by all means to bear with the obligation that they have to align all laws and out of 390 laws which had been set for alignment, 158 have been identified as key areas where alignment is needed.
“The Ministry have since printed more than 500 000 copies of the constitution in English, 350 000 in other languages and 4 000 in braille.
“We have also taken it to be a government obligation that we align the laws to the new constitution as we have by now had 158 laws set aside as critical for alignment out of the total 390,” said Mabhiza.local

We won’t vacate the streets- Vendors

Vendors in Masvingo have vowed never to vacate the Central Business District to honour government June 26 ultimatum saying council should first develop the proposed new market site near the Dr Grace Trade Centre popularly known as Chitima Market.
Chaos loomed at the site Friday morning as vendors demanded answers from council officials over the development of stalls, after which the officials fled the scene as the situation got tense.

Scores of vendors almost caused mayhem at the market site, with some shouting that they were not moving from the streets until toilets and a security fence have been built for their service at the site.
Masvingo Informal Traders Association (MITA) president Gilbert Chikwata had to call for calmness from the crowd, telling people to exercise patience as the director of Housing responsible for the allocation was said to be in a meeting, a call which was met with more resistance from the crowd.
“Let us respect the leadership here; the allocation will be done after the meeting, our council officials have gone back to call the Director of Housing whom l heard is in a meeting at the moment”, said Chikwata.
A vendor only identified as Gidza said, vendors were ready to vacate the streets only if the council could be more organised and ensure proper sanity at the new market place, also making sure that the place was going to accommodate all the vendors in the streets.
“The place is not even fenced, there are no toilets at the moment, and it will become a health threat to all of us, because the place cannot even accommodate all the people. We cannot spend the whole day standing here because we depend on vending, so we are going back in the streets,” said Gidza.
Masvingo city Mayor Hubert Fidze said officials from the council were going to deal with the issue.
“Nothing has changed, everything will go on as we discussed yesterday in that meeting (informal trade dialogue meeting), our officials will come to the site. It’s still morning, we have the whole day, definitely they will come”, said Fidze.local
 

‘ We will drive all vendors to Chitima flea market by tomorrow’

Masvingo City Council (MCC) Director of Housing Mr Levison Nzvura said all vendors will be driven to Chitima flea market by tomorrow (26 June) where work is being done to accommodate more than 500 hundred informal traders.
Speaking at an Informal Traders  meeting with vendors at Civic Center on Thursday, Nzvura said the council wanted all illegal traders to comply with the government directive to leave the streets by Friday 26 June.
“Work is being done at the new market site, and tomorrow people will be allocated their working space, however everyone should register through my office. At the moment 470 people have registered”, said Nzvura.
Masvingo Informal Traders Association (MITA) president Gilbert Chikwata said his members were ready to comply with the directive.
 “It is no longer the time to continue fighting and demonstrate against the local government. It is high time we help develop our nation by restoring sanity and order in our city”, said Chikwata.
In an attempt avoid fighting and misunderstanding in the near future SMEs District Business Development Officer John Masvinu pleaded with the council to make use of lease agreements and ensure that the place is properly serviced.
“People will obey the deadline, however the council should make use of lease agreements that can be renewed so that in future there will not be any problems”, said Masvinu.

Masvingo Town Clerk Adolf Gusha said a $1 will be charged as daily rentals and further added that everyone will be moved in peace as they will be allocated to their working spaces at the new market site.
“We appreciate your coming to this meeting where we have resolved this issue in a peaceful manner. Let it be clear to everyone that a $1 will be charged as daily charges at the new market place”, said Gusha.
However, some vendors have since blasted Chikwata for misrepresenting them saying they were not going to leave the streets soon.
“Chikwata does not represent us. We were not invited to that meeting and tomorrow will be business as usual in the streets,” said a vendor who declined to be named.local
  
  

15 Zanu PF candidates eye Bhasikiti’s constituency

At least 15 Zanu PF members have submitted their Curriculum Vitaes (CVs) to be considered for Primary Elections in Mwenezi East constituency which fell vacant following the outspoken Kudakwashe Bhasikiti’s dismissal from both the party and parliament recently.
However, Bhasikiti says he is still the Member of Parliament (MP) for the area. He said recent developments in the party were shocking because ‘ under normal circumstances, the court outcome was supposed to be heard before anyone compete for the constituency’.

“I do not know what they are doing because the issue is before the courts as we speak. I was never given a dismissal letter and I do not know the crime which I committed to warrant dismissal. I don’t want to comment a lot because the case is before the court but I am sure justice will take place,” said Bhasikiti.
Masvingo provincial chairperson for Zanu PF Paradzai Chakona told Tell Zimbabwe that people had already submitted their CVs for vetting.
“Yes I can confirm that people are already submitting their CVs and 15 candidates have already come forward,” said Chakona.
Although Chakona did not give names of those who are eying Bhasikiti’s constituency, Tell Zimbabwe was informed that losing candidate for Masvingo Urban constituency in 2013 Zanu PF Primary elections Jusibee Omar is tipped to take the constituency.
However, Omar who have some farms in Mwenezi is likely to face a serious challenge from the current Mwenezi  Rural District Council (RDC) chairperson Samuel Masukume.

Church forces lecturers to sleep in open

The Reformed Church in Zimbabwe (RCZ) has shocked both believers and none believers from Mogernster Mission after forcing four lecturers including their children from its Teachers’ College to sleep in the open over dispute yesterday.
The College Lecturers Association of Zimbabwe (COLAZ) has described the move as devastating and shocking.
The youngest child who also joined her parents in the cold June night is three months old.
 The four; Finos Mawere, Yemurai Sithole, Benedict Mavesere and Martin Mutema. Speaking to Tell Zimbabwe, COLAZ President David Dzatsunga said it is shameful for one of the most renowned church to act in such an inhumane manner.
“It is quite shameful and shocking for one of the most renowned and oldest church in Zimbabwe to act in such an inhuman manor where families are forced to sleep in the open cold with children as young as two year olds. You even fail to understand whether they are acting in their senses as such a move would be persisted by many as demonic,” blasted Dzatsunga.


Dzatsunga went on to say that as an independent body, they are going to make an appeal against the evictions as he argues that the long going dispute which started in 2012 as the above mentioned lecturers demonstrated against poor services by the RCZ run institution was long resolved by the labour court that they stay at their respective placements.
“We are definitely going to appeal against the move in as soon as possible. COLAZ is doing this because the evictions are unjust.
“I say so because the dispute which resumed in 2012 was swiftly dealt with by the labour court which called for the reinstatement of the lecturers after the Ministry of Higher and Tertiary Education had called for their transfers for practicing their right to be heard when they demonstrated against the poor working conditions offered by the institution,” further challenged Dzatsunga.
Meanwhile, Masvingo Province Reformed Church of Zimbabwe General Secretary; Reverent Charles Juro denied giving comment towards the church’s position on the on-going tensions as he openly denied having information about the evictions on his desk and further said his office is too high that such information would not be quickly available.
“I do not have that information. I urge you to go to the spot where these events are said to have occurred and see maybe the Principal that you may get what really transpired until the lecturers in question got ejected.
“You should also be aware that my office is too high to have such information quickly as you would not even expect the Roman Catholic Vicar General to have information happening in the Catholic society overnight,” said Juro.
When contacted for comment, Mogernster Teacher’s College Principal, Mrs Chipato admitted that the said lecturers were evicted but she refused to shed light over the circumstances.
“Those evictions were done but who am I to comment on issues pertaining the church and its employees. I do not want to be involved in such issues,” said Chipato.local

Wezhira FM staff live in fear

Masvingo based Wezhira Community radio initiative staff are living in fear following threats by the Zimbabwe Republic Police (ZRP) Law and Order section officers who summoned two staff members for questioning early this week.
Their lawyer Martin Mureri, of Matutu and Mureri legal practitioners, said the police wanted to know everything with regards to the operations at Wezhira as they suspected that they were broadcasting unlawfully.


“Mica Zinduru and Wilson Maphosa were yesterday (Monday) called for questioning at the ZRP Law and Order section for suspected unlawful activities but they were later let go without charge.
“They claimed that the station was broadcasting unlawfully and was also successfully pushing its agenda through social media platforms like WhatsApp, but we made it clear to them that Wezhira is not broadcasting but simply waiting for a broadcasting license from authorities so that they can operate,” said Mureri.
“They (police) were also keen to know who was behind the station and they probably suspected the station could be pushing an opposition political agenda. We made it clear that the two are simply hanging around there so that should a license be granted, they will stand a chance to get jobs.”
“As for now, we don’t know what the police may do next and people at Wezhira are living in fear,” added Mureri.local

Masvingo to borrow US$1, 7 million for trunk sewer

Beleaguered City of Masvingo has resolved to borrow a massive US$1, 7 million to complete its stalled Mucheke Trunk Sewer in a move that is likely to invite the ire of the burdened ratepayer.
Recently, city managers were forced to eat humble pie after they had vehemently resisted directives from the local governance ministry ordering deep salary cuts to boost the city’s service delivery reserve.
In a notice published in the Sunday Mail on June 15, Town Clerk Adolf Gusha reveals that the trunk sewer project requires the massive capital injection to be completed.
“Masvingo City Council has resolved to apply to the Minister of Local Government, Public Works and National Housing of Borrowing Powers in the sum of One Million seven hundred thousand dollars (US$1700000),” reads part of the notice.
It also goes on to say the money is needed for the trunk main sewer completion, trunk water main and the trunk road.
Latest council minutes on the same project also reveal that the trunk sewer is only 68 percent complete due to lack of funds.
Masvingo Residents Trust (MRT) Programmes Manager Prosper Tiringindi said his organisation opposes reckless borrowing that would further burden the ratepayers.
“Council should cut on their luxury expenditure like hotel allowances and endless benefits for their senior employees and channel the money to the project. We believe with a bit of austerity, this project can be completed without getting ourselves into debt,” said Tiringindi.
Anoziva Muguti, Chairperson of the Masvingo United Residents and Ratepayers Association (MURRA) said he expected authorities to consult widely with residents.
“We believe they should consult the residents first and hear from them. They cannot just borrow on behalf of residents without our knowledge. We are against armchair decisions especially those that have financial implications,” said Muguti.
     Unfinished job ….Masvingo needs 1,7 million to finish this project
The project is lagging far behind schedule after its 2013 deadline lapsed due to several factors including failure by the pipe supplier to deliver on time and suspected contractual disputes.
Mayor Hubert Fidze has however maintained that the initial cost of the project was underestimated by the previous council board.local

Masvingo giant cement project in limbo

The cement manufacturing plant slated for the Charumbira area south-east of Masvingo is still just but a plan with no guaranteed chance of success just like similar projects that have proposed in the past, it has been learnt.
This comes amid indications that although a prospective investor has been found, requisite feasibility studies for the project have not yet been carried out.
Numerous other plans for cement manufacturing plans have come to naught in the past despite the discovery of vast marble and limestone deposits in the vicinity of Masvingo.
Masvingo Rural District Council (MRDC) has also not yet found alternative land to relocate an estimated 600 families who would be affected should the project be successfully implemented.
State media reported at the beginning of this month that land would be found to resettle the families and that the project after a Chinese investor had shown interest.
MRDC chairperson, Peter Marambira, however, said feasibility studies are yet to be done before the project could be given the green light.
“As council we have simply made a resolution to the effect that we would like to see the project succeed but a lot of work still needs to be done,” said Marambira.
“Requisite studies have to be conducted first to determine the feasibility of the project before the mine is given the go-ahead to operate,” added Marambira.
If successfully implemented the project is expected significantly drive down the retail price of cement in Masvingo and improve the infrastructure in the surrounding communities.

Minister of State for Masvingo Provincial Affairs, Shuvai Mahofa could not shed any light on the issue.
“I don’t have the details with me yet. The details are known by the concerned company,” said Mahofa.
In the early 90s, government’s plans to enter into partnerships with private investors to set-up a cement factory yielded nothing.
